To be appointed as Avon`s new representative, you may need to enter into a separate agreement with New Avon („representation agreement“). If you have a representative agreement, we may collect, use and disclose your personal data in accordance with this privacy policy and under your „representation agreement.“ We may also collect, use and disclose your personal data if necessary to meet our obligations under the Representative Agreement. In the event of a conflict between this declaration of confidentiality and the representative agreement, the terms of the representative agreement apply. All disputes with Avon or our parents, subsidiaries, affiliates, executives, directors, employees, agents or affiliates arising from or in connection with this Agreement are settled exclusively by non-contestable arbitration with an arbitrator, in accordance with the rules of the American Arbitration Association of New York, NY. If the trip to New York is a burden, you can participate fully in the arbitration by telephone or through documents, which the arbitrator authorizes. Each party will bear its own costs of arbitration, unless the arbitrator specifies that the management of these costs would be an unreasonable burden and, in this case, Avon will pay your share of the administrative costs of the arbitration (but not the legal fees). You agree to resolve all disputes related to this agreement as an individual and not as a class or to join a class. You understand that in exchange for the approval of this provision and the provision at issue above, Avon is able to offer AVON`s websites on the specified terms, and that your consent is an indispensable consideration in this agreement.
You also recognize and understand that our senior executives, directors, employees, representatives or affiliates that arise from or in connection with your use of AVON`s websites or this agreement: YOU ARE RIGHT TO A TRIAL BY JURY; AND YOU ARE ON YOUR RIGHT, AS A REPRESENTATIVE, AS A PRIVATE ATTORNEY GENERAL, OR IN ANY OTHER REPRESENTATIVE CAPACITY, OR TO BECOME A MEMBER OF A CLASS OF CLAIMANTS, INVOLVING ANY LAWSUIT INVOLVING ANY DISPUTE.
